वह एक अंधेरी शरद ऋतु की रात थी। बूढ़ा बैंकर पंद्रह साल पहले शरद ऋतु में दी गई पार्टी को याद करते हुए अपने अध्ययन के लिए बार-बार आ रहा था। मेहमानों में कुछ विद्वान पत्रकार और एक वकील थे। चर्चा का विषय था कि जो भी बेहतर हो; 'मृत्युदंड' या 'आजीवन कारावास' उनमें से लगभग सभी ने मृत्युदंड को अस्वीकार कर दिया। मेहमानों में से एक की राय थी कि न तो मृत्युदंड और न ही आजीवन कारावास उचित या उचित था।

मेजबान जो एक बैंकर था, ने कहा कि उनकी राय में मृत्युदंड आजीवन कारावास से अधिक मानवीय था क्योंकि फांसी एक बार में मार देती है जबकि आजीवन कारावास डिग्री से मारता है। इनमें करीब पच्चीस साल का एक युवा वकील भी था। उन्होंने कहा कि हालांकि मृत्युदंड और आजीवन कारावास दोनों समान रूप से अनैतिक हैं, लेकिन तुलनात्मक रूप से आजीवन कारावास इस अर्थ में बेहतर है, 'कुछ जीने की बजाय जीने के लिए।'

इसी बात को लेकर बैंकर और वकील के बीच बाजी लग गई। वकील ने पंद्रह साल के लिए एकांत कारावास में प्रवेश करने की पेशकश की। बैंकर ने 15 साल के कारावास को सफलतापूर्वक पूरा करने पर वकील को दो मिलियन रूबल (रूसी मुद्रा) का भुगतान करने की शर्त लगाई। समझौते ने सभी सूक्ष्म विवरणों के लिए प्रदान किया जिसने कारावास को सख्ती से एकान्त बना दिया।

समझौते के अनुसार वकील ने कक्ष में प्रवेश किया और वर्ष 10 बीतने लगे। उसने अपने पंद्रह साल के कारावास को सबसे अनिश्चित स्थिति में बिताया और एक कंकाल में सिमट गया। अगले दिन 12 बजे वह अपनी आजादी वापस पाने के लिए जा रहा था और बैंकर से दो मिलियन रूबल का दावा कर रहा था।

लेकिन इस समय तक बैंकर की आर्थिक स्थिति बहुत खराब थी, अगर वह दो मिलियन हो गया, तो वह हमेशा के लिए बर्बाद हो जाएगा। उसके लिए समस्या का एकमात्र समाधान वकील की मृत्यु थी। उसे केवल वकील के कक्ष में प्रवेश करना होगा और उसे तकिए से दबाना होगा, जिससे अप्राकृतिक मृत्यु का कोई निशान नहीं रह जाएगा।

तीन बजे बैंकर सावधानी से अपने घर के बागीचे में दाखिल हुआ जहाँ वकील रखा गया था। उसने टेबल के पास बैठे वकील को घूर कर देखा। बैंकर फिर वकील की कोठरी में दाखिल हुआ और कैदी के मुड़े हुए सिर के सामने एक लिखित नोट पड़ा देखा। वकील ने नोट में लिखा था कि उन्होंने इस पार्थिव जीवन का पन्द्रह वर्षों तक अध्ययन किया था और इसके खोखलेपन का पता लगा लिया था। उन्होंने अपने पुस्तकों के अध्ययन से ज्ञान प्राप्त किया था और महसूस किया था कि इस दुनिया में सब कुछ दूरदर्शी है और मृत्यु के विनाश के अधीन है। वह अब उन दो लाख लुटेरों से नफरत करता था जिसके लिए उसने स्वेच्छा से जीवन के पंद्रह वर्ष बर्बाद किए थे।

अपना दावा ठोकने के लिए वह तय समय से पांच मिनट पहले समझौते का उल्लंघन कर अपनी कोठरी से बाहर आ गया। अगली सुबह चौकीदार दौड़ता हुआ आया और उसे सूचित किया कि कैदी खिड़की से बगीचे में चढ़ गया है और फिर गायब हो गया है। बैंकर तुरंत अपने नौकरों के साथ उस कमरे में गया और अपने कैदी के भागने की पुष्टि की। उसने राहत महसूस की और अनावश्यक अफवाहों से बचने के लिए उसने मेज से कागज लिया और अपने कमरे में लौटकर उसे अपनी तिजोरी में बंद कर दिया।

It was a dark autumn night. The old banker was coming again and again to his studies, remembering the party he had given in the autumn fifteen years ago. Among the guests were some learned journalists and a lawyer. The topic of discussion was whichever was better; 'Death penalty' or 'life imprisonment' Almost all of them rejected the death penalty. One of the guests was of the opinion that neither the death penalty nor life imprisonment was just or proper.

The host, who was a banker, said that in his opinion the death penalty was more humane than life imprisonment because hanging kills in one go while life imprisonment kills by degree. Among them was a young lawyer of about twenty-five years. He said that though both death penalty and life imprisonment are equally immoral, but comparatively life imprisonment is better in the sense, 'to live for rather than to live something'.

There was a dispute between the banker and the lawyer regarding this matter. The lawyer offered to enter solitary confinement for fifteen years. The banker conditioned the lawyer to pay two million rubles (Russian currency) on successful completion of 15 years of imprisonment. The agreement provided for all the subtle details that made the imprisonment strictly solitary.

According to the agreement, the lawyer entered the chamber and the year 10 began to pass. He spent his fifteen years' imprisonment in the most precarious position and was reduced to a skeleton. The next day at 12 o'clock he was on his way to regain his freedom and was claiming two million rubles from the banker.

But by this time the financial condition of the banker was very bad, if he became two million, he would be doomed forever. For him the only solution to the problem was the death of the lawyer. All he has to do is enter the lawyer's chamber and press him to the pillow, leaving no trace of unnatural death.

At three o'clock the banker carefully entered the garden of his house where the lawyer was kept. He stared at the lawyer sitting by the table. The banker then entered the lawyer's cell and saw a written note lying in front of the prisoner's folded head. The lawyer wrote in the note that he had studied this earthly life for fifteen years and discovered its hollowness. He had gained knowledge from the study of his books and realized that everything in this world is visionary and is subject to the destruction of death. He now hated the two lakh robbers for which he had voluntarily wasted fifteen years of his life.

To stake his claim, he came out of his cell five minutes before the stipulated time in violation of the agreement. The next morning the watchman came running and informed him that the prisoner had climbed through the window into the garden and then disappeared. The banker immediately went to that room with his servants and confirmed the escape of his prisoner. He felt relieved and to avoid unnecessary rumours, he took the paper from the table and returned to his room and locked it in his safe.
